Party Sanctions

Article VII. Party Sanctions

Section1.  All Party officers and members are subject to party discipline.

Section2.  Party disciplinary measures shall range from warning, censure, and  suspension, up to expulsion.

Section3.  The disciplinary authority shall be (1) the Chapter to which the erring member belongs or (2) the Barangay Party Council to which that said Chapter belongs or (3) the Party City Council.

Section4.  Disciplinary measures short of expulsion shall be imposed by majority vote  of all members of the disciplinary authority.

Section5.  A Party member may be expelled by two thirds (2/3) vote of all the  members of the sanctioning authority for any of the following grounds:

  1. Disloyalty to the Party;
  2. Rejection to undergo further education in the Party Academy as the Party City Council may require;
  3. Unjustified failure and/or refusal to help, aid, assist, and/or campaign for the official candidates of the Party;
  4. Unjustified failure and/or refusal to support and campaign for the official stand of the Party on issues as determined or approved by the Party City Assembly or the Party City Council;
  5. Other acts inimical to the Party as determined by the Party City Council.

Section6.  The following shall be grounds for the automatic expulsion of members from the Party:

  1. Taking on oath of Membership in or Allegiance to any other local political party in Angeles City;
  2. Maintaining a membership in another local political party in Angeles City even after induction into the PARTIDO ABE KAPAMPANGAN;
  3. Filing a certificate of candidacy for any office or position under auspices of another local political party in Angeles City;
  4. Refusal or failure to pay the annual membership dues as prescribed by the Party City Council for two consecutive years.

Section7.  Before imposing disciplinary action on any member, such member shall be given sufficient notice in writing of the charge(s) against him or her, given  sufficient opportunity to properly defend himself or herself in person or by                                     counsel, and be given a fair hearing by the penalizing authority concerned.  The decision of the Chapter or concerned Council shall be reduced to writing and furnished to the member concerned.

 Section8.  Every decision may be appealed within fifteen (15) days from written notice to the next higher Party level, all the way up to the Party City Council, whose decision shall be final.

Section9.  The procedure rules on the imposition of the relief from Party discipline shall be promulgated by the Party City Council, upon advice from the Legal Affairs and Arbitration Committee.
